Terms of Service

By accessing and using the Exam Rehearsal Platform ("Platform", "Service", "we", "us", or "our"), you accept and agree to be bound by these Terms of Service and our Data Protection Policy.

If you do not agree to these terms, you must not use our Platform. We reserve the right to modify these terms at any time. Your continued use of the Platform following any changes constitutes acceptance of those changes.

2.1 Account Creation

To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

2.3 Account Types

The Platform offers two types of accounts:

• Student Accounts: For purchasing and taking practice tests
• Educator Accounts: For creating, publishing, and monetizing educational content

3.1 Test Purchases

All tests on the Platform are priced at $9.95 USD per test. Payment is processed securely through Stripe. Upon successful payment, you receive unlimited access to retake the test for 12 months from the purchase date.

3.2 Access Period

Test access expires 12 months after purchase. You will receive reminder notifications 30 days, 7 days, and 1 day before expiration. After expiration, you must repurchase the test to regain access.

3.3 Refund Policy

Refunds may be granted within 7 days of purchase if:

• The test content is significantly different from what was advertised
• Technical issues prevent you from accessing the test
• You have not completed the test

3.4 Prohibited Activities

Students must not:

• Share account credentials or test access with others
• Copy, reproduce, or distribute test content
• Use automated tools to access or scrape test content
• Attempt to circumvent content protection measures
• Submit false or fraudulent reviews

4.1 Verification and Approval

All educators must undergo a verification process before creating tests. This includes submitting:

• Valid teaching credentials or professional qualifications
• Government-issued identification
• Proof of subject matter expertise

We reserve the right to reject or revoke educator status at our discretion.

4.2 Content Standards

All test content must:

• Be original or properly licensed
• Be factually accurate and educationally sound
• Be free from offensive, discriminatory, or inappropriate content
• Include clear explanations for correct answers
• Comply with applicable copyright laws

4.3 Content Ownership

You retain ownership of your test content. By publishing on the Platform, you grant us a non-exclusive, worldwide license to display, distribute, and market your content through the Platform.

4.4 Revenue Sharing

Educators earn a commission on each test sale. The commission structure is as follows:

• Platform retains a percentage for operational costs and services
• Educators receive the remaining percentage
• Minimum payout threshold: $500 USD
• Payouts are processed within 7-14 business days after request

4.5 Test Review Process

All tests undergo administrative review before publication. We may:

• Request modifications to meet quality standards
• Reject tests that don't meet our requirements
• Remove published tests if quality issues are identified

4.6 Educator Conduct

Educators must not:

• Submit plagiarized or copyrighted content without permission
• Create fake accounts to purchase or review their own tests
• Manipulate ratings or reviews
• Harass or engage in unprofessional conduct with students

5.1 Platform Content

The Platform, including its design, logos, graphics, and software, is owned by us and protected by copyright, trademark, and other intellectual property laws.

5.2 User Content

Educators retain ownership of their test content. Students may not reproduce, distribute, or create derivative works from test content without explicit permission.

5.3 Copyright Infringement

If you believe content on the Platform infringes your copyright, contact us immediately at contact@examrehearsal.com with details of the alleged infringement.

6.1 Pricing

All tests are priced at $9.95 USD. Prices are displayed in USD and may be converted to your local currency by your payment provider.

6.2 Payment Processing

Payments are processed through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's terms and conditions.

6.3 Taxes

You are responsible for any applicable taxes, duties, or fees related to your purchases.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

The Platform is provided for educational purposes only. We do not guarantee specific exam results or outcomes. Test content is created by third-party educators, and while we review content for quality, we cannot guarantee absolute accuracy.

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms of Service
• Fraudulent or illegal activity
• Abuse of the Platform or other users
• Non-payment of fees

Upon termination, your access to purchased tests will be revoked, and no refunds will be issued except as required by law.

These Terms shall be governed by and construed in accordance with the laws of Botswana. Any disputes arising from these Terms or your use of the Platform shall be resolved through:

1. Good faith negotiation between the parties
2. Mediation, if negotiation fails
3. Arbitration or litigation in Botswana, if mediation is unsuccessful

We may update these Terms of Service from time to time. We will notify users of material changes via email or through a prominent notice on the Platform. Your continued use of the Platform after changes constitutes acceptance of the revised terms.
